Zoning Board Public Hearings on Seasons' Request for Three Special Use Permits
WHAT COMES NEXT: The next hearing date will be anounced at the regular Zoning Board meeting on December 4.
Preserve Tiverton's real estate expert testified at the November 6 hearing about the much greater impact on the neighborhood of the Seasons project requiring three special use permits than a use that was permitted by right. On July 17, our traffic expert testified to the many flaws in the traffic study presented by Seasons and argued that the project would add more congestion and hazards to an already overburdened intersection. On August 22, Preserve Tiverton had a planner testify as to why the criteria to grant the three special-use permits requested by Seasons have not been met.
Showing up to the hearings is important because it lets both the Zoning Board and the Town Council know that residents still stand firm in their opposition to this project. Seasons is hoping to wear down our opposition. Don't let them!

Seasons needs three different special use permits to proceed with their project: one for the gas station; one for the coffee shop with drive-through window; and one for numerous brightly lit signs (the exact number and specific type keep changing).
In order to be granted its special use permits, Seasons must convince the Zoning Board that "such use in its proposed location meets the following requirements:
(1) The public convenience and welfare will be served.
(2) It will not be detrimental to the public health, safety, morals or welfare.
(3) It will be compatible with neighboring uses and will not adversely affect the general character of the area.
(4) It will not create a nuisance in the neighborhood, nor hinder or endanger vehicular or pedestrian movement.
(5) It will have adequate provision made for water service, sanitary sewage disposal and fire protection. The board may accept reports of the state department of health and registered professional engineers, land surveyors or sanitarians, as proof of the adequacy of these facilities.
(6) It will be compatible with the comprehensive community plan of the Town of Tiverton."
If the proposed use fails to meet even one of these required standards, it must be denied!
These standards can be found on p. 74 of Appendix A Tiverton Zoning, Article XVI. - Special Use Permits of the Tiverton Code of Ordinances.
NOTE: Although an update to zoning eliminated the requirement that the special use comply with Tiverton's Comprehensive Community Plan, the Seasons project must meet these earlier zoning requirements that were in effect when the project was submitted.

Development Proposals We Are Following
Seasons 24-Hour Gas and Convenience Store with Drive-Through
Tiverton Heights Housing Development is a 275-unit housing project proposed on a 135-acre parcel located between Main Road and Fish Road just north of Souza Road. It is currently (Summer 2020) under review by the RI Dept. of Environmental Management (DEM) because it would alter 13,865 square feet of freshwater wetlands. You can see maps of the project, read a Newport Daily News article about it, and read Save the Bay's letter urging DEM to deny the wetlands alteration permit.
Oxford Development is a mixed-use project proposed for a 8.1-acre parcel abutting the Tiverton Heights Development described above. It would include 46 residential units and 16,850 square feet of commercial space . A Newport Daily News article describing the project was published in November 2021.
